Terms of Service

1. Introduction and Agreement

These Terms of Service (the "Terms") govern your access to and use of Hard Money Lenders of Montecito (the "Site"), operated by Lead Skills, LLC ("we," "our," or "us"). By accessing the Site or submitting an inquiry, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Our Role: Lead Generation Service

The Site is a lead-generation service that connects borrowers seeking hard money financing with participating lenders that may be interested in their inquiry. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All such activities are performed by participating lenders in their sole discretion, subject to their own underwriting criteria and applicable law.

3. No Offer or Solicitation

Nothing on the Site constitutes an offer or solicitation to lend, an offer to extend credit, a commitment to lend, or a guarantee of loan approval, rates, or terms. Submitting an inquiry does not guarantee that you will be matched with a participating lender or receive any loan offer. Any rate, term, or program description on the Site is illustrative only and is not binding on us or any participating lender.

4. Eligibility

To use the Site, you represent and warrant that:

• You are at least 18 years of age and have legal capacity to enter into binding contracts.
• The information you submit is your own (or you are authorized to submit it) and is accurate, complete, and current.
• You will use the Site only for lawful purposes and in accordance with these Terms.

5. Your Consent to Be Contacted

When you submit an inquiry and check the "Consent to Contact" box, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any text or by calling 805-749-5840. A current list of participating lenders is available upon request.

6. Equal Opportunity

Hard Money Lenders of Montecito connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree not to:

• Submit false, misleading, or fraudulent information.
• Submit information about another person without their authorization.
• Use the Site to violate any law or any third party's rights.
• Attempt to interfere with, probe, scan, or test the security of the Site or its underlying systems.
• Use automated means (bots, scrapers, harvesters) to access or collect content from the Site, except for search-engine crawlers acting in good faith.

8. Intellectual Property

The Site, including its content, design, graphics, logos, and underlying technology, is owned by Lead Skills, LLC or its licensors and is protected by copyright, trademark, and other laws. You may view and use the Site for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works from any part of the Site without our prior written consent.

9. Third-Party Links and Services

The Site may contain links to third-party websites or services, and may share your inquiry with participating lenders that operate independently. We do not control and are not responsible for the content, availability, accuracy, or practices of any third party. Your use of any third-party service is governed by that party's own terms and privacy policy.

10. Disclaimers

THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE OR COMPLETE. INFORMATION ON THE SITE IS FOR GENERAL INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE FINANCIAL, LEGAL, TAX, OR INVESTMENT ADVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL LEAD SKILLS, LLC, ITS AFFILIATES, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Lead Skills, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Site, (b) any information you submit, (c) your violation of these Terms, or (d) your violation of any law or any third party's rights.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any action arising out of or relating to these Terms or the Site must be brought in the state or federal courts located in Santa Barbara County, California, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may modify these Terms at any time. When we do, we will post the revised Terms on this page and update the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
